WHAT IS BAIL?
BOND- Customarily a written instrument in which one party (the principal or obligor) agrees to perform some act for the benefit of a second party (the obligee), and a third party (the surety) agrees to pay the sum of money that has been fixed as the penalty if the principal fails to perform. In Chapter 648, F.S., “bond” is used to signify all types of pre-trial release.
WHAT IS A BAIL BOND? HOW DO BAIL BONDS WORK?
A bail bond is a contractual agreement between the Bail Bondsman (Surety), the Principal (person who bond was for), and the Indemnitor (person who puts up the collateral). In short, this agreement stipulates that the bail bond agency will post the bail amount required by the court in exchange for a fee, with the indemnitor held responsible for repaying the bail bond agency. If the person released from jail does not show up for their court hearing the court keeps the bail money, therefore the Indemnitor is held responsible.
HOW MUCH DOES A BAIL BOND COST IN THE STATE OF FLORIDA?
In Florida, the fee for a bail bond is 10% of the bail amount set by the court. For instance, if bail is set for $50,000, the fee paid to the bail agency will be $5,000.
